Terms of Service

1. Acceptable use

You may only send commercial email to recipients from whom you have verifiable, recorded consent. You will not use the service to send unsolicited bulk email, scraped/purchased lists, deceptive subject lines, or content that violates the CAN-SPAM Act, Gmail/Yahoo bulk-sender requirements (Feb 2024), or applicable law in the recipient's jurisdiction.

We monitor complaint rate. Accounts exceeding a 0.1% complaint rate over a rolling 7-day window may be paused without notice to protect shared sender reputation.

2. Compliance you're responsible for

  • Maintaining proof of consent for every contact (CSV imports, signup forms, manual adds).
  • Providing your accurate physical postal address (CAN-SPAM §5(a)(5)).
  • Honoring unsubscribes — Elite Webmail enforces this automatically via the suppression list.
  • Not re-uploading suppressed addresses (we reject these at the import endpoint, by design).
  • Verifying your sending domain (DKIM/SPF/DMARC via Resend) before bulk sending.

3. Subscription and payment

Free Trial accounts are provided without payment for 30 days. Paid subscriptions are billed in advance for the period you select (monthly or annual). Annual plans renew automatically; you may cancel any time and the cancellation takes effect at the end of the current period.

4. Termination

You may cancel your account at any time from Settings → Account. We may suspend or terminate accounts that violate Section 1, fail payment, or pose unreasonable risk to other customers' deliverability.

5. Data ownership

You own the data you upload (contacts, messages, content). We hold it only to provide the service. On termination we delete it within 30 days, except suppression-list entries we retain indefinitely per CAN-SPAM §316.5.

6. Warranties and limits

The service is provided "as is." We do not warrant uninterrupted delivery; mailbox providers may filter or reject mail outside our control. To the maximum extent allowed by law, our aggregate liability is limited to fees you paid in the prior 12 months.

7. Changes

We'll post material changes here with at least 30 days' notice via the email on your account.
